Agreement and seller

These Terms govern orthotruss.com and general use of OrthoTruss software, simulators, guides, and connected services (the “Services”). Jean-Marc E. Choufani operates under the OrthoTruss brand, at 701 Buckskin Drive, Round Rock, Texas 78681. The current Pioneer Terms of Service name OrthoTruss LLC as the seller of Pioneer. The seller and contract for a particular purchase are identified in the agreement presented for that product. By using a Service, you agree to the applicable terms. See the Privacy Policy for data handling.

Paid Services are offered in the United States to adults legally able to purchase for professional or business use, subject to the applicable product terms.

Product-specific agreements control their product. If a versioned purchase, trial, subscription, or software license agreement conflicts with this general page, that accepted product agreement controls, including its payment, cancellation, liability, and dispute provisions. Updating this page does not replace an existing perpetual license or rewrite a previously accepted dated agreement. The August 20, 2026 agreement remains available as a historical record; new Pioneer purchases use the linked September 19 agreements below.

Educational & research tools

The OrthoTruss™ biomechanics simulators, calculators, and related software (the "Tools") are provided for education, training, and research. They illustrate general biomechanical and material-science principles using transparent, published equations. Every output is intended to help users understand and study the underlying physics.

Educational use and clinical boundaries

The public educational Tools are intended to illustrate principles using model inputs. They are not intended to diagnose, recommend treatment, or provide a patient-specific treatment forecast. Do not use their outputs as clinical advice for an individual. These educational-use limits do not describe the separate Studio and Practice Conductor clinical record applications. Their intended functions, release status, and connected-service requirements are described on the Clinical Platform pages and in the applicable product documentation. Nothing on this website represents blanket regulatory clearance, clinical validation, or a compliance certification for the product family.

Professional responsibility

The diagnosis and treatment of patients require the independent judgment of a qualified, licensed healthcare professional who has examined the patient. The Tools do not replace clinical examination, professional judgment, or established standards of care. Any clinical decision is the sole responsibility of the treating professional.

Accuracy & limitations

Simulations simplify real systems. Read the documented assumptions, sources, validation scope, and limitations of the specific model you use; a citation does not establish clinical validity for every use. Educational, market, planning, and AI outputs may be incomplete, inaccurate, or outdated. Verify important results against primary sources and qualified professional judgment.

Practice Pioneer — additional terms

The following terms apply specifically to the OrthoTruss™ Practice Pioneer desktop application and related Practice Pioneer web services (together, "Pioneer") and supplement the general terms above.

Planning tool — not professional advice

Pioneer is planning and organization software. It is not a franchise, business opportunity, income program, or promise of profit, savings, financing, licensing, credentialing, compliance, or practice success. Outputs—including cash-flow scenarios, budget estimates, lender-package drafts, market analyses, lease flags, checklists, timelines, and AI responses—depend on assumptions and may be incomplete, inaccurate, or outdated. They are not legal, tax, accounting, investment, lending, real-estate, insurance, regulatory, or clinical advice. Verify material decisions with qualified advisers and primary sources.

Trials, subscriptions & refunds

Pioneer Pro subscription options are managed through the Pioneer web account. Pioneer Pro is $100 per month or $1,000 per year, plus applicable tax. New subscriptions are available through the Pioneer web account; separate optional 72-hour no-card trial starts remain paused, and a trial never converts automatically. A deliberately started trial or subscription is governed by the versioned Pioneer Terms of Service and Subscription Schedule shown before activation or checkout. Subscription payments are non-refundable after payment except where required by law or for duplicate, incorrect, or documented OrthoTruss billing corrections.

Location Scout access and refunds

A new Location Scout purchase is a one-time $300 purchase that provides 30 days of web access beginning when payment is completed. It does not create a Pioneer Pro credit. Credits already earned under an earlier accepted agreement remain available under that agreement's eligibility and expiration rules.

Except where required by law or approved to correct a billing error, Location Scout purchases are final and non-refundable. If a partial or full refund or chargeback is issued, Scout access ends. The treatment of any previously earned unused credit follows the agreement under which it was granted; credit already redeemed remains recorded and is not clawed back.

License scope

A new Pioneer Pro subscription provides paid access only for the provider-confirmed trial or paid-through period and does not erase local projects when access ends. Existing perpetual Pioneer purchases retain the local-use contract for the purchased major version; they are not converted into subscriptions. Hosted services, updates, support, AI, and third-party data remain subject to their applicable terms and availability.

AI-generated content

Hosted AI is an optional Pro feature, uses Anthropic, and is subject to reasonable usage limits and provider availability. AI-generated content may be inaccurate, incomplete, outdated, or non-unique. Do not submit PHI and do not rely on AI output as a substitute for professional review.

Planned Pioneer Signals

Pioneer Signals, formerly Practice OS, is currently parked and not offered for purchase. Market Signals and Practice Pulse describe planned workflows. Signing up for updates does not create a subscription or reserve access. Pioneer Pro does not depend on Pioneer Signals. Any future offering will present its applicable terms before purchase.

Clinical Platform availability

Studio Free and Practice Conductor Free provide the capabilities identified for their current release; some functions remain in beta. Studio Advanced and Conductor Pro sales are paused for further validation. Reference pricing is not an offer to activate an unavailable module. A free download, preview, or feature description does not grant access to every planned function. For current scope and updates, see clinical plans and waitlists.

Planned features and update lists

Pioneer Signals, Market Signals, Practice Pulse, Dental Opportunity Explorer, and expanded verified provider intelligence describe work in development, with no promised release date or guaranteed scope. Join a Pioneer topic list for updates. A waitlist is an email opt-in, not a purchase, deposit, place reservation, or entitlement. Future paid offerings will show their price and terms before purchase.

Tax and financial planning

Koinon Tax is in development for tax preparation and planning. Estimates, simulations, and preparation packages do not constitute a filed return or acceptance by a tax authority. You remain responsible for reviewing records, assumptions, elections, and any final filing with the appropriate professional or filing service. Previewed workflows do not establish public availability or professional representation.

Privacy & data

Do not enter protected health information into Practice Pioneer, public simulators, support requests, or hosted AI. Those Services are not clinical record systems, and OrthoTruss does not offer a HIPAA business associate agreement for them. Intellectual property & trademarks

OrthoTruss™ is a trademark of Jean-Marc E. Choufani. OrthoTruss software and original content are proprietary except where a specific license states otherwise. Third-party software, publications, images, and museum materials remain subject to their respective ownership, licenses, and attribution notices; some displayed historical works are in the public domain. No blanket ownership claim is made over those materials. Unauthorized use of the OrthoTruss name or logo in connection with another product or service is prohibited. The underlying biomechanics engine is proprietary. The research library is made available under a source-available, citation-required license; research use that relies on the engine must cite it as specified in that license. Commercial and clinical-practice use of the library requires a separate license.

Acceptable use and suspension

You are responsible for your entries, decisions, credentials, recovery information, exports, and backups. You may not resell or share license keys, bypass access controls, scrape hosted services, introduce malicious code, violate law or third-party rights, or evade usage limits. Paid or hosted access may be suspended for a refund, chargeback, material breach, fraud, abuse, security risk, or unlawful use.

Warranty disclaimer

To the maximum extent permitted by law, the Services are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or results. Nothing excludes a right that applicable law does not allow to be excluded.

Limitation of liability

To the maximum extent permitted by law, Jean-Marc E. Choufani and OrthoTruss will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; lost profits, revenue, data, opportunities, or goodwill; or decisions made from Service outputs. Aggregate liability arising from a paid product will not exceed the amount paid for the product giving rise to the claim. Aggregate liability arising solely from a no-cost product will not exceed US $100. These limits do not apply where prohibited by law.

Disputes and governing law

Before filing a claim, email a written description to [email protected] and allow 30 days for informal resolution. Texas law governs these Terms. An unresolved claim may be brought in an eligible small-claims court or a state or federal court located in Williamson County, Texas. No mandatory arbitration provision applies.

Changes and complete agreement

Material changes will be identified by a new effective date and presented for renewed acceptance when required. If one provision is unenforceable, the rest remains effective. These Terms and incorporated policies govern general Service use, subject to the product-specific agreement precedence described above. Existing accepted purchase and license rights are preserved.
